Custody/Allocation of Parental Responsibilities


The concept of “custody” has been replaced by “allocation of parental responsibilities,” which involves both decision-making and parenting time. Responsibility for decision making of major issues involving a child’s health, education, religion, or extracurricular activities may be allocated to one parent solely, or to both parents jointly, depending on what is in the child’s best interests. This is separate and apart from the issue of allocation of parenting time. If the parents do not reach an agreement, the court may appoint an attorney to act as a Guardian ad Litem to represent the child(ren)’s best interests, or experts to make recommendations as to what allocation is in the child’s best interests.
