Many couples have children without entering into marriage. In these cases, the Court may need to legally declare the father to be the biological father of the child in order for the father to have parental rights and responsibilities regarding the child. This is true even if the father is named on the child’s birth certificate.

Under Illinois Law, the same standards regarding custody/allocation of parental responsibilities and child support which are applied to divorcing couples apply to unmarried parents.
