If a parent who has at least 50% of the parenting time wants to move with their child(ren) more than 25 miles (or 50 miles in some circumstances) away from their home, they need the agreement of the other parent, or approval by the court, before doing so. The court will consider whether the move is in the best interests of the child (not the parent) and whether a reasonable parenting time schedule can be arranged for the parent remaining in Illinois. Relocation matters are incredibly fact specific. It is best to consult with an experienced family law attorney at Collins Family Law prior to making any decision regarding a move to discuss the impact on your parenting schedule and child(ren).
In the event a resolution cannot be reached with the other parent, our attorneys have extensive experience in representing both parents seeking the court’s approval to move away, and those defending move away requests.
